General commercial terms for construction and engineering enquiries, quotations, project execution, payments and handover.
Scope and Formation of Contract
These Terms & Conditions apply to website enquiries and serve as general commercial terms for proposed construction and engineering services. The signed quotation, work order, drawings, bill of quantities, specifications and project agreement will control the actual project. If there is a conflict, the signed project documents will prevail.
Quotation and Price Validity
A quotation is based on the information available when it is issued and remains valid only for the period stated in it. Prices may be revised before contract signing if material, labour, fuel, tax or statutory costs change.
Measurements and Built-Up Area
Billing measurements, slab area, built-up area, elevation projections, balconies, staircases, utility areas, compound works and other chargeable portions will be calculated according to the method stated in the signed quotation or agreement.
Owner Responsibilities
The client or property owner must provide lawful site possession, ownership documents, approved drawings where applicable, site access, decisions and payments on time.
- Obtain or authorize required permissions and statutory approvals unless specifically included in our scope.
- Provide water, electricity, storage and access as agreed.
- Disclose site disputes, encumbrances, underground utilities and structural concerns.
- Avoid directly instructing labour or subcontractors in a way that changes the approved work.
Design, Approvals and Changes
Work will follow mutually approved drawings and specifications. Any addition, deletion, upgrade, rework or change requested after approval may result in a variation order, revised price and additional time. Verbal changes should be confirmed in writing.
Payment Terms
Payments must be made according to the milestone schedule in the signed agreement. Delayed payments may lead to suspension of work, extension of the completion date, demobilisation or additional costs. Taxes and statutory charges will apply as specified.
Materials and Procurement
Materials will be procured according to the agreed brands and specifications, subject to market availability. Client-supplied materials must reach the site on time and be suitable for use. Delays, defects or shortages in client-supplied items may affect the schedule and quality responsibility.
Quality Checks and Site Access
Sri Sunrise Associates may conduct stage-wise quality checks and coordinate relevant inspections. The client may inspect the site with reasonable prior notice while following safety requirements. Concealed work should be inspected before the next stage wherever required.
Demolition, Geology and Pest Control
Demolition of an existing building, geologist or water-diviner services, borewell-related work, and termite or pest-control treatment will be carried out only when included in the final scope. Results such as groundwater availability, yield, soil behaviour or complete pest elimination cannot be guaranteed because they depend on natural and site-specific conditions.
Completion, Handover and Defects
Completion and handover will follow the project agreement. Minor snag items that do not prevent reasonable use may be recorded and rectified within an agreed period. Warranty or defect-liability obligations apply only to the extent and duration stated in the signed contract, excluding normal wear, misuse, unauthorised alterations, external leakage sources, natural movement and third-party work.
Delay and Force Majeure
Reasonable extensions may apply for delays caused by weather, natural events, strikes, government restrictions, approval delays, shortages, accidents, utility interruptions, client changes, payment delays or other events beyond reasonable control.
Suspension and Termination
Either party may suspend or terminate the project according to the signed agreement. The client remains responsible for completed work, ordered materials, committed services, demobilisation and other applicable charges up to the effective termination date.
Liability and Indemnity
Each party remains responsible for its own breach, negligence and unlawful conduct. Liability, indemnity and insurance requirements for a project will be governed by the signed agreement and applicable law.
Dispute Resolution and Jurisdiction
The parties should first attempt to resolve disputes through written discussion and good-faith negotiation. Any further process, including mediation, arbitration or court proceedings, will be governed by the signed agreement and applicable Indian law. Subject to that agreement, courts in Hyderabad, Telangana will have jurisdiction.
